PARTICIPANT RELEASE AND WAIVER OF LIABILITY

This PARTICIPANT RELEASE AND WAIVER OF LIABILITY (this “Release”) is entered into as of the date set forth below by the individual identified below (“I” or “me”) in favor of ICTLL1, LLC, as operator of the Learning Lab Wichita (“Lab”), and its members and affiliates and their officers, directors, contractors, volunteers, and agents (collectively, the “Organization”).

I desire to engage in activities at/with the Lab on a volunteer or other basis (the “Activities”). I understand that the Activities may include educational activities and interacting with others. I also understand that as a Participant, unless separately agreed by Lab or another party, I will receive no compensation for my services (if any), will not be eligible for employee benefits, and am not an employee of Organization.

In exchange for being allowed to participate in the Activities and for other good and valuable consideration, the receipt and sufficiency of which I acknowledge, I freely and voluntarily sign this Release and agree to the above and following terms:

1.  Compliance with Policies. I will comply with the Lab’s code of conduct and other applicable policies and procedures, training, and safety rules of Organization, and will follow its guidance in carrying out the Activities.

2.  Assumption of Risk. I understand that some Activities may be inherently dangerous or expose me to unforeseen risks. I expressly assume such risks, including any risk of injury, harm, or loss that I may incur through my participation in the Activities.

3.  Liability Release and Waiver. I fully and forever release and discharge Organization from, and expressly waive, all liability, claims, and demands of any kind or nature, either in law or in equity, that may arise from my participation in the Activities. I agree not to make or bring any such claim or demand against Organization, and fully and forever release and discharge Organization from liability under same. I UNDERSTAND THAT THIS RELEASE DISCHARGES ORGANIZATION FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST IT WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF ORGANIZATION OR OTHERWISE.

4.  Insurance. I UNDERSTAND THAT ORGANIZATION DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE OF ANY NATURE IN THE EVENT OF MY INJURY, ILLNESS, OR DEATH, OR DAMAGE TO OR LOSS OF MY PROPERTY. I also understand that Organization does not provide workers' compensation insurance for non-employees. I expressly waive any claim for compensation or liability on the part of Organization in the event of any injury or medical expense.

5.  Indemnification. I agree to indemnify, defend, and hold harmless Organization from all liability, losses, damages, judgments, or expenses, including attorneys' fees, that it may incur or sustain due to my participation in the Activities, to the extent arising out of any third-party claim, including without limitation due to my negligence or willful misconduct.

6.  Media Release. I understand and agree that during the Activities, I may be photographed and/or videotaped by the Organization or media for internal uses and/or to promote the Lab. I grant and convey to Organization all right, title, and interest in any such photographs or recordings, and consent to the use of my name, image, likeness, and voice in perpetuity, in any medium or format, for any such uses, by Organization or its designees solely in furtherance of the Lab’s mission, each without further compensation to me or separate permission from me, with the understanding that any use other than to promote the Lab and its good works will require my separate permission.

7.  Other Terms. This Release represents the full understanding between Organization and me and supersedes all other prior understandings or representations, written or oral, between us with respect to the above subject matter. If any term of this Release shall be deemed invalid, that term shall be modified to be valid and enforceable to the full extent permitted. The invalidity of any such term shall not otherwise affect the validity or enforceability of the remaining terms. This Release is binding on and inures to the benefit of Organization and me as Participant and to our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. This Release is intended to be as broad and inclusive as permitted, and shall be governed by and interpreted in accordance with the laws of the State of Kansas. 

BY AGREEING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE ABOVE TERMS AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ORGANIZATION.
